Chapter I General Provisions
Article 1 (Purpose)
The purpose of these terms of service is to set out the conditions and procedures for using all services (hereinafter referred to as “Services”) provided by the website of Incheon International Airport Corporation (hereinafter referred to as the “Website”), as well as to define the rights, duties, responsibilities, and other necessary affairs between the users and the Website.
Article 2 (Effect and Modification of the Terms)
- 1These terms of service apply to all users who wish to use the Website, including customers registered with the Website.
- 2 The terms take effect as soon as they are posted on the Website’s interface or communicated to the members via other means, and they become binding upon the user’s registration with the Website.
- 3 Should Incheon International Airport Corporation deem it necessary, it reserves the right to modify these terms, and any modifications will be promptly communicated to the users using the same means outlined in the paragraph 2.
Article 3 (Supplementary Provisions to the Terms)
Any matters not explicitly set out within these terms will be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulations of the Information and Communication Ethics Committee, the Code of Ethics for Information and Communications, and any other relevant laws and regulations.
Article 4 (Definitions of Terms)
For the purposes of these terms, the following definitions apply:
- 1User : Any individual who receives services provided by the Website in accordance with these terms.
- 2User Agreement : The contract concluded between the Website and the user concerning the use of services.
- 3 Registration : The act of completing the service agreement by filling out the required information on the application form provided by the Website and agreeing to these terms.
- 4 Member : An individual who has provided the personal information necessary for membership registration with the Website, thereby gaining access to the information and services offered by the Website.
- 5User (ID) : A combination of letters and numbers selected by the user and assigned by the Website to identify the user and grant access to the services.
- 6 Password (PW) : A combination of letters and numbers selected by the user to verify their identity as the registered member and to protect the privacy of their personal information during communications.
- 7Withdrawal (Termination) : The act of a member terminating the user agreement.
Chapter II Formation and Termination of the Website User Agreement
Article 5 (Formation of the User Agreement)
- 1The user agreement is established when the user expresses their agreement to these terms and submits an application for service use, which is subsequently approved by the Website.
- 2Agreement to these terms is indicated by the user’s selection of “I agree to the above terms” during the application process.
Article 6 (Membership Registration and Termination)
- 1Membership registration is complete when the applicant, following identity verification, fills out the required information on the prescribed registration form provided by the Website and submits it to the Website.
- 2The Website reserves the right to revoke membership registration under the following circumstances:
- 1) If the application was made using another person’s name.
- 2) If the information provided in the membership application were falsified or submitted falsely.
- 3) If the application was made with the intent to disrupt public order or cood customs and practices.
- 4) If the applicant has interfered with another person’s use of the Website’s services or has engaged in activities such as stealing information.
- 5) If the applicant uses the Website to engage in activities prohibited by law or these terms.
- 6) If the membership application requirements set by the Website are incomplete.
- 3The Website may defer the formation of the user agreement until the cause is addressed in any of the following circumstances:
- 1) If there is insufficient capacity related to the service.
- 2) If there are technical difficulties.
- 4The services provided by the Website include, but are not limited to the following, and the Website may inform any changes to be made to the services to users and provide services modified from those described below:
- 1) All services developed by the Website or provided in consultation with other organizations.
- 5Members must immediately notify the Website of any changes to their registration details by editing member information or other methods as prescribed by the Website.
- 6If the user no longer wishes to receive services provided by the Website after membership registration, the user may withdraw (terminate) their membership at any time.
Article 7 (Assignment and Modification of User ID, etc.)
- 1The Website assigns a user ID to the user in accordance with these terms.
- 2As a matter of principle, a user ID cannot be modified; if there is an unavoidable circumstance to change it, the existing ID must be terminated and a new one registered (confirmation required).
- 3A user ID may be changed upon the request of the user or the company in the following circumstances:
- 1) If the user ID is the same as the user’s phone number or resident registration number, giving rise to privacy concerns.
- 2) If the user ID is offensive or contrary to good customs and practices
- 3) If there are other reasonable grounds.
- 4The user is responsible for the management of the user ID and password. Any damages or unauthorized use by third parties resulting from negligent management of the user ID and password are the responsibility of the user, and the Website bears no responsibility.
- 5Other matters related to the management and modification of user information are governed by the policies set forth by the Website.
Article 8 (Consent to Use of Member Information)
- 1Your personal information is subject to the privacy policy of the Website.
- 2Member information on the Website is collected, used, managed, and protected as follows:
- 1) Collection of Personal Information: The Website collects your information through the details you provide during service registration.
- 2) Use of Personal Information: The Website does not disclose or distribute your personal information to third parties without your consent, except when required by law, requested by a government agency, necessary for criminal investigations, or requested by the Information and Communication Ethics Committee. Disclosure may also occur if you have voluntarily disclosed your personal information on the Website.
- 3) Management of Personal Information: You are allowed to modify or delete your personal information at any time for privacy protection and management through the personal information management service on the Website. You may also modify or adjust certain received information you deem unnecessary.
- Protection of Personal Information: Your personal information can only be viewed, modified, or deleted by you, and this is managed exclusively through your ID and password.
Therefore, you must not share your ID and password with others, and you should log out and close your web browser after completing your session.
(This is especially important when you use public computers in places like internet cafes or libraries where they are shared with others.)
- 3 Your application to use the Website in accordance with these terms and service is deemed your consent to the collection and use of the member information provided in the application form.
Article 9 (User Information Security)
- 1From the moment you complete the service registration process on the Website, you are held responsible for maintaining the confidentiality of your information and are accountable for all outcomes resulting from the use of your ID and password.
- 2The responsibility for managing the ID and password rests solely with you, and should you become aware of any unauthorized use of your ID or password, you must immediately report the findings to the Website. Failure to do so will place full responsibility for any resulting damages on the member.
- 3Users must ensure they log out after each session, and the Website accepts no liability for any damages or losses arising from a third party misappropriating your information due to your failure to log out.
Chapter III Use of Services
Article 10 (Service Availability)
- 1The service availability is, as a matter of principle, year-round and 24 hours a day, provided there are no special operational or technical impediments to the Website.
- 2However, the Website may designate specific days or times for regular inspections or other necessary activities, which will be exceptions to this rule.
Article 11 (Service Suspension and Notification of Suspension)
- 1The Website bears no responsibility for any content, including messages or other communications stored or transmitted through the service, that is not stored or is deleted, or for any messages not transmitted due to national emergencies, power outages, service facility failures beyond the control of the Website, or other force majeure events.
- 2The Website may temporarily modify, change, or discontinue services with prior notice and will not be held liable to users or any third party for any such modifications, changes, or discontinuations.
- 3The Website may also discontinue services without prior notice for reasons such as urgent system maintenance, expansion, or replacement, or may completely discontinue current services if deemed appropriate, replacing them with new services.
- 4In cases where it is impossible to provide normal services due to events such as national emergencies, power outages, or service facility failures, the Website may restrict or discontinue all or part of the services. In such instances, the reason and duration will be communicated to users either before or after the discontinuation, depending on the circumstances.
- 5The Website is not obliged to provide prior notice for service discontinuations caused by reasons beyond its control (such as unintentional disk failures or system crashes without any intentional act or negligence of the system administrator) or system discontinuations caused by third parties (e.g., PC communication companies, telecom operators).
- 6The Website may divide the services into specific segments and designate separate availability hours for each segment. In such cases, this will be communicated accordingly.
- 7The Website reserves the right to restrict or suspend a user’s access to services if the user violates the terms outlined in these terms of service, and may terminate the user agreement without the user’s consent. In such cases, the said user will be no longer have access to the Website.
Article 12 (Information Provision and Advertisement Publication)
- 1During the course of operation of its services, the Website may provide users with various types of information by posting such information on the homepage or through other adequate means.
- 2The Website may also display advertisements deemed adequate for the services or in the public interest.
Article 13 (Management and Operation of Posts on the Website)
- 1The rights to the content of posts uploaded by users belong to the respective users.
- 2The Website reserves the right to edit or relocate any posted content without prior notice, and may delete content without prior notice in the following circumstances:
- 1) If the post violates these terms of service, or if the content is deemed commercial, illegal, obscene, or vulgar.
- 2) If the content defames or slanders other members or third parties, thereby damaging their reputation.
- 3) If the content violates public order or good customs and practices
- 4) If the content is deemed as being associated with criminal activities.
- 5) If the content infringes upon the copyrights or other rights of third parties.
- 6) If the content violates any other relevant laws and regulations.
- 3The user bears full civil and criminal liability for any damages arising from posts that infringe upon the copyrights of others.
Article 14 (Service Use Restrictions)
- 1If the information provided by a user is found to be false, or if there is reasonable cause to suspect that the information is false, the Website may, in part of in full, suspend the user’s access to the service without bearing any responsibility for any resulting disadvantages.
- 2The Website may also, at its own discretion, restrict or suspend the service use of a user who has engaged in behavior that violates Article 16 (Duties of Members) or any other provisions of these terms. In such cases, the Website may block the user’s access to the Website.
Chapter IV Duties and Responsibilities
Article 15 (Duties of the Website)
- 1The Website is obligated to refrain from engaging in any acts prohibited by law or contrary to good customs and practices and to strive to provide continuous and stable services.
- 2The Website does not disclose or distribute the personal information of members to third parties without the consent of the individual, except when required by relevant telecommunications laws or other applicable laws and regulations.
- 3The Website is required to have a security system in place to protect the personal information of users to allow them to use the services securely.
- 4The Website is not held liable for any service disruptions caused by reasons attributable to the user.
Article 16 (Duties of Members)
- 1Members are required to provide accurate information requested during registration. In addition, members must maintain and update their information to ensure its accuracy. Members must not allow third parties to use their ID and password.
- 2Members are prohibited from engaging in any commercial activities using the services provided by the Website without prior consent from the Website.
- 3Members may not copy, reproduce, modify, translate, publish, broadcast, or otherwise use information obtained through the Website’s services or provide it to others without prior approval from the Website.
- 4Members are prohibited from engaging in any of the following conducts during the course of their use of the Website’s services:
- 1) The unauthorized and fraudulent appropriation of another member’s password and ID.
- 2) The transmission, posting, or dissemination of content that is vulgar, obscene, insulting, threatening, or invasive of another’s privacy.
- 3) The deliberate falsification or misrepresentation of the origin of content transmitted through the service.
- 4) The publication, posting, or transmission of content that is prohibited by law or contract.
- 5) The infringement of another’s patents, trademarks, trade secrets, copyrights, or other intellectual property rights through the posting, dissemination, or otherwise making available of such content.
- 6) The distribution, posting, or transmission of unauthorized advertisements, promotional materials, spam, chain letters, pyramid schemes, or other forms of solicitation without prior approval from the Website.
- 7) The unauthorized collection or storage of other users’ personal information.
- 8) The engagement in or association with activities that are criminal in nature or related to the commission of a crime.
- 9) The execution of conduct that are contrary to public morals or disruptive to social order.
- 10) The defamation, insult, or other acts that damage the reputation of others.
- 11) The violation of another’s intellectual property rights or any other rights.
- 12) The engagement in hacking activities or the distribution of computer viruses.
- 13) The persistent transmission of advertising information or other content to individuals against their intentions.
- 14) The engagement in any conducts that disrupt or could potentially disrupt the secure operation of the service.
- 15) The unauthorized alteration of information posted on the Website.
- 16) The participation in conducts that contravene the provisions of Article 53 (1) of the Telecommunications Business Act and Article 16 (Obscene Communications) of the Enforcement Decree of the Telecommunications Business Act.
Chapter V Miscellaneous
Article 17 (Ownership of the Website)
- 1The intellectual property rights and other rights related to the services provided by the Website, including but not limited to the software, images, marks, logos, designs, service names, information, and trademarks, are owned by the Website.
- 2Users are not permitted to modify, rent, lease, loan, sell, distribute, produce, transfer, sublicense, create a security interest in, or commercially exploit any of the aforementioned properties in whole or in part, nor are they allowed to permit third parties to engage in such activities, except where expressly approved by the Website.
Article 18 (No Transfer)
It is not permissible for members to transfer or gift their right to use the services or any other positions under the user agreement to third parties, nor can they provide them as collateral.
Article 19 (Compensation for Damages)
The Website will not be held liable for any damages incurred by members in connection with the use of services provided free of charge, except in circumstances where the damage results from an intentional criminal act committed by the Website.
Article 20 (Disclaimer)
- 1The Website is exempt from liability for the provision of services if it is unable to provide services due to natural disasters, wars, or other force majeure events of a similar nature.
- 2The Website is also exempt from liability if damage is sustained because the telecommunications services provided by the primary telecommunications carrier are interrupted or not provided correctly.
- 3The Website is exempt from liability for damages arising from the unavoidable circumstances such as maintenance, replacement, regular inspection, or construction of service facilities.
- 4The Website is not held responsible for damages caused by errors on the user’s computer or for damages caused by the member’s provision of incomplete personal information or email address.
- 5The Website has no duties to guarantee or represent the accuracy, completeness, or quality of information displayed on the service, and the Website does not endorse, oppose, or modify any opinions expressed by members or third parties. The Website is not liable for any benefits obtained or damages sustained by members or any third party as a result of relying on information contained within the service.
- 6The Website is not held responsible for any transactions or financial dealings conducted between members or between members and third parties using the service as a medium, nor will it be responsible for any benefits that members expect to gain from the use of the services.
- 7The Website is not held liable for any gain or loss expected by using the service or any damages sustained as a result from the data obtained through the service, and the Website assumes no responsibility for the reliability of information, data, or facts posted by members on the service.
- 8The Website is not liable for damages incurred by users due to their intentional acts or negligence in connection with the use of the service.
- 9The Website does not guarantee the accuracy, completeness, or quality of services provided by subscribers or other affiliated institutions that are not offered by the Website. Therefore, the Website will not be liable for any losses or damages incurred by users from the use of such services. Furthermore, the Website is not responsible for compensating users for any mental harm caused by other users while using the service.
Article 21 (Jurisdiction)
In the event of any disputes arising in connection with the use of the service, litigation may be brought before the competent court in accordance with the Civil Procedure Act.
Addendum
- 1(Effective Date) These terms of service will come into effect on November 1, 2011.
